N.Y. Governor Near Deal On Indian Casino May 9, 2003 ALBANY - After two decades of impasse, Gov. George E. Pataki is close to reaching an agreement with the St. Regis Mohawk tribe that would settle a longstanding land-claim lawsuit against the state. And, if the federal government ratifies the deal, it would allow the tribe to open a casino in the Catskills. Pataki and leaders of the tribe had been scheduled to sign the agreement on Wednesday afternoon, but the ceremony was called off at the last minute when the tribe objected to a minor provision that would have required wholesalers who sell products on the reservation to be licensed by the state, according to lobbyists and administration officials. Still, the major planks of the accord have been worked out and it is expected to be signed this week, officials said. Under the tentative agreement, the tribe would receive about $100 million over 35 years from the state and federal governments to resolve its claim it was tricked out of thousands of acres of land more than two centuries ago. The money would be used to buy about 7,000 acres from willing sellers adjacent to the St. Regis reservation, which straddles the St. Lawrence Seaway in the northern Adirondacks and Canada. The tribe would also receive two islands in the seaway as well as 95 acres of other state-owned land, officials said. The deal would allow the Mohawks to open a casino at the former Kutsher's Country Club outside Monticello, N.Y., and to add slot machines to its existing Akwesasne Casino in St. Regis. In return, the state would receive a fifth of the revenue from slot machines at the new casino, growing to a quarter share in four years -- a revenue stream of at least $100 million a year, officials said. The agreement would be the first and most important in a series of steps that would lead to a casino 90 miles from New York City. The deal still requires approval by the federal Interior Department and members of the Mohawk tribe, and parts of the agreement require action by the state Legislature. In addition, the land-claims settlement requires the approval of Congress. The casino could still be derailed by two lawsuits challenging the legality of all Indian casinos in the state. The Court of Appeals is expected to rule soon on the first of those lawsuits. Still, the accord would eliminate one of the largest hurdles to developing the Catskills casino, a $500 million project that officials in Sullivan County hope will revitalize the region's fading resort industry. |
