Both Sides Hold Jokers In Indian Casino Game May 11, 2003

onoma -- When it comes to the political poker of big-buck Indian casinos, everyone seems to be playing with marked cards. A good example is the proposal by a little-known band of American Indians to build a mega-buck slot machine mecca in a scenic North Bay cow pasture, south of the Sears Point raceway.

Both the Indians and their opponents, it appears, have a few aces in the hole. On the table is the plan by 600 members of the newly constituted Coast Miwoks and Southern Sonoma County Pomos to build a Vegas-style casino -- never mind that they won federal recognition for their tribes after promising not to go into the gambling business.

Quicker than you can say "hit me," once they had that recognition, they came up with a 2,000-acre land deal so the tribes would have a home and teamed up with a Las Vegas casino operator to run the place. Here's the full house of well-connected lobbyists and consultants who are dealing the hand:

Darius Anderson, the A-list political money guru, lobbyist and personal friend of everyone from Gov. Gray Davis to San Francisco Mayor Willie Brown. Anderson's Kenwood Investment Co. bought up options on Sonoma County farmland to create the tribes' made-to-order reservation.

Doug Boxer, the attorney son of Democratic U.S. Sen. Barbara Boxer and a partner in Anderson's Kenwood Investments.

Chris Lehane, a.k.a. the "Master of Disaster," who served as Bill Clinton's White House mouthpiece during the Monica Lewinsky affair, then went on to serve as Al Gore's presidential campaign spokesman.

Lehane also happens to be an unpaid adviser to Davis. Now he's been tapped to help put the right spin on the casino project.

Stuart Sunshine, a protege of bad-boy political consultant Jack Davis who has worked for both Brown and former San Francisco Mayor Frank Jordan. His most recent assignment was heading San Francisco International Airport's controversial runway program.

Now Sunshine has left that job for Kenwood Investments, where he'll be pushing the casino development. For all the firepower on the casino side, eyebrows also are being raised over the role of Sonoma County Supervisor Valerie Brown, who is fighting the project.

Supervisor Brown, it turns out, has been moonlighting -- to the tune of $180,000 a year -- as executive director of California Cities for Self- Reliance. That's a joint powers authority set up by four Los Angeles-area cities to battle Indian casinos that might pull money away from the towns' cardrooms.

Brown said she gets her money from the cities, but Jimmy Gutierrez, the group's general counsel, has been quoted as saying that cardrooms pumped in $260,000 to get the anti-casino group up and running. Gutierrez was out of the country last week and unavailable for comment.

Even if the cardrooms down south are a source of Brown's moonlighting cash, she insists there's nothing that would disqualify her from taking an active role opposing the Sonoma casino. In both cases, Brown said, her goal is to make sure that cities have "a place at the table. . . . There's no difference."

Brown isn't the only one coming under the conflict scope. As it turns out, it was Sen. Boxer herself who wrote the legislation that restored the two tribes' federal status back in 2000 and paved the way for the casino play.

At the time, the understanding was that the tribes would not build a casino. So what's Boxer saying now? For starters, she says her son wasn't working for Anderson at the time she carried the bill, and that as soon as Doug told her last year that the tribes had hired Kenwood Investment, she agreed not to get involved any further in their dealings.

"I feel terrible about it. . . . I'm very disappointed," she told us Friday. "I had a promise from them (the tribes) that they weren't going to do gambling." In fact, Boxer said she had planned to put a gambling prohibition into the legislation she carried, but was told it was unconstitutional.

By the way, from what we're hearing, whatever the pros and cons of this mega-casino deal, there may not be any way of stopping it. "It's not a matter of if -- but when," says one casino insider.

That's largely because the federal recognition of the tribes gives them sovereign status and limits what anyone can tell them they can -- and cannot -- do on their own land. Still, the tribes will be using all the political muscle they have to help build community support -- and to
